Terms
Last updated: 30 October 2026. These terms are between you and Web Landscapes LLC, a Florida company trading as Healthcare Software ("we"). Sections 1 to 3 apply to everyone using healthcare-software.com. Sections 4 to 12 apply when you order work from us. A signed proposal or statement of work can change them for a specific project; if it does, the proposal wins.
1. The website and guides
The guides on this site, including the tracking guide and the HIPAA page, are general information. They are not legal advice, and reading them doesn't create a client or attorney relationship with anyone. Laws and guidance change; each guide says when we last checked it.
2. The free tracker scan
- Use it for websites you own or manage, or to check sites for your own research.
- Don't use it to overload a site, to get around our rate limit, or in an automated way.
- The scan reads the code a page sends and matches it against a list of known trackers. It can miss trackers and can't tell you whether a vendor has a BAA. A result of "no trackers found" is not a statement that a site complies with any law.
- We may change, limit or stop the scan at any time.
3. Our content
You may link to and quote short parts of our guides with a link back. Please don't copy whole pages.
4. Quotes and orders
Prices are on the pricing page or in a written quote. A quote is valid for 30 days. Work starts when you accept the quote in writing and pay what's due to start.
5. Payment
- Tracker audit: paid in full before we start.
- Website build: 50% to start, 50% at launch. If you put a project on hold for more than 60 days, we invoice the work done so far.
- Care plan: billed monthly in advance.
- Hourly work: billed monthly at the agreed rate, against an estimate we give you first.
- Invoices are due within 14 days.
6. What you provide
- Accurate content: services, providers, hours, insurance, photos you have the right to use.
- Access we need, such as read-only access to your tag manager or your domain registrar.
- Your own accounts and agreements with your scheduler, portal, EHR and form services, including their business associate agreements.
- Decisions about your own legal obligations, with your compliance officer or counsel where needed.
7. Patient information
We design our work so we don't receive protected health information. If a project would give us access to it, we sign a business associate agreement with you before starting, and that agreement governs it. Don't send us patient information outside such an agreement.
8. Audits
An audit reports which scripts and vendors we found on your site on the day we checked, and what they appeared to receive. It is a technical review, not a legal opinion or a certification of HIPAA compliance. Sites change; a script added after the audit isn't covered.
9. Website builds
- Two rounds of changes are included. More changes, or changes to the agreed scope, are billed at the hourly rate after we tell you the estimate.
- When you've paid in full, you own the site's content and design. We keep the right to reuse our own general code and tools in other work.
- We don't show your site as an example without your written permission.
10. Care plan
The care plan runs month to month. Either side can end it with 30 days' notice by email. When it ends, we hand over the site files and help move the domain. Unused edit time doesn't carry over to the next month.
11. Liability
We do the work with reasonable skill and care. Apart from that, the site, the scan and our work are provided as they are. Our total liability for any claim about our work is limited to what you paid us in the 12 months before the claim, except where the law doesn't allow that limit. We aren't liable for indirect losses, or for problems caused by third-party services you choose, such as your scheduler or ad platforms.
12. Law
These terms are governed by Florida law. Any dispute goes to the courts of Miami-Dade County, Florida.
